By using this Website, you indicate that you accept these Terms and Conditions and that you agree to abide by them. If you do not agree to these Terms and Conditions, please refrain from using the website.

These Terms and Conditions apply to persons raising funds known in this contract as the “Star”, the provider of the donation or sponsorship known as the “Donor” and to all visitors to the Website.

Please read these Terms and Conditions carefully.

1. About Inspire Giving

Inspire Giving Limited, registration no. 8254124, trading as Inspire a Star (“IAS”), operates the website www.inspireastar.org that provides space for “Stars” to set up profiles and facilitates the processing of gifts and donations (the “IAS Services”). These Terms and Conditions govern your use of the IAS Services.

2. Use of the Site and User Conduct

Inspire Giving Limited, as operator of the IAS website, provides a platform for profiles of “Stars” and the mechanism for Donors to contribute. Inspire Giving Limited does not take responsibility for any user-generated content or information displayed on the Website. If the Company has knowledge of any unlawful or offensive activity it shall remove or disable access to this information.

As a user of the Website you agree that the content posted by you will not:

break any law or encourage an illegal act;
be defamatory, abusive or offensive nor upload offensive, obscene or racist content;
infringe the copyright, privacy, confidentiality or other right of any third party. If you use someone else’s material or image, you must get the copyright owner’s written consent to use it;
include surveys, raffles, lotteries, contests, pyramid schemes, advertisements or chain letters;
contain software viruses or any other computer code, files or programs designed to affect the use of any computer software or hardware or telecommunications equipment.

In addition, it is not permitted to:

misrepresent your identity or pretend to be associated with something when you are not
use the Inspire Giving website to send junk emails or ‘spam’ to people who do not want to receive email from you.

We require that you are aged 16 or above to register as a Star on the Website and use the IAS services. However, if you are below the age of 16 you are still able to register on the website as a Star provided that a parent or guardian confirms the registration on your behalf.

We do not actively edit the Website but we reserve the right to remove or edit any content posted. If you notice any content that breaks these conduct rules, please notify us. By displaying the profile of a Star on the Website does not imply our endorsement of the Star.

3. Site Content and Information

All information and materials (including designs, text, graphics and their selection and arrangement together with our logo, trading name and brand identity) shown on this Website are the copyright of Inspire Giving Limited, Inspire a Star Management Limited or our content providers. No information or material on this Website may be copied, reproduced or downloaded without our express permission in writing.

You own all of the content and information you post on the IAS website. In order for IAS to use certain types of content and provide you with the services, you agree to the following:

For content that is covered by intellectual property rights, like photos and videos (“IP content”), you specifically grant IAS a non-exclusive, royalty-free, worldwide perpetual licence (which we could transfer or sub-licence) to use any IP content that you post on or in connection with IAS (“IP Licence”). You can terminate this licence by contacting us when you delete your IP content or your account (except to the extent your content has been shared with others, and they have not deleted it).

4. Payment Processes for Donations / Sponsorship

All payments are to be made by  debit or credit card through Stripe.  Please note that we do not accept payment by cash or cheques.

Stripe is a global technology company whose software allows individuals and businesses to receive payments over the internet. Stripe provides technical, fraud prevention and banking infrastructure required to operate on-line payment systems.

Stripe will deduct credit/debit card fees from funds paid to a “Star” at their published rate. Fees vary depending upon the location of the “Star” and whether donations are made using a domestic or international credit card. See example in Section 8.

The details of any donation will be displayed on the Website before it is processed. If you wish to correct an error you can do this by following on screen direction before proceeding to confirm the transaction. As soon as you confirm to us through the Website that you wish to proceed with your donation you are authorising us to process the transaction and request funds from your credit or debit card provider. Once we have received cleared funds from you we will send you an e-mail confirming that the payment has been made. The donation will be displayed on the Star’s profile page.

We will only process donations in the nominated currency. Interest will not accrue or be payable on funds that we process. Arrangements for donations to be transferred to the bank accounts of the Star’s or their parents or guardians are made by Inspire Giving within 7 days of the Star reaching their funding target or the event deadline and them providing accurate bank account details. In certain cases it may take a few days for the payment to clear the banking system and reach the destination bank account.

5. Use of Your Gift / Donation

Please note that the individual you are making a gift or donating to may use your donation or payment at their discretion. We ask the individual to agree that they will use the funds received for their specified purpose. When an individual creates their profile page they are required to tick a box promising that if they reach their target they will use the funds for their specified purpose and if they do not reach their target they will still use any funds raised towards their target for their specified sport. However, this is not guaranteed.

IAS is not responsible for any dissatisfaction you may have regarding the recipient’s use of any donation you make through the Website or its associated services. We do not able to monitor or control the individuals’ activities.

6. Unauthorised Card Use

If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

7. Refunds

It is not Inspire Giving’s policy to issue refunds. Please ensure that your payment details are correct before confirming your transaction.

8. Fees

It is FREE to register your profile on the Inspire a Star website.

If you do not raise any money you pay nothing.

If you do raise money the only charges are the 5% Inspire a Star administration fee on the funds raised  plus any finance charges associated with raising your funds. The finance charges are the fees charged by our payment provider Stripe. These amounts will be subtracted from the amount you raise.

When you are deicding how much you need to include as your target please  factor in both the finance charges and the Inspire a Star admin fee.

For example, if you are looking to raise £100 when you complete your profile page you should factor in a 5% Inspire a Star administration fee and also the Stripe charges.

For Stripe accounts in the UK the charge is 1.4% plus 20p per transaction and 2.9% for non-European cards.

For example if you raise  £400  the Inspire a Star admin fee will be  £20. The Stripe fees will depend upon whether your donors use European or non-European cards and whether you receive one donation of £400 or many smaller donations. If you raise the £400 from one UK card the Stripe fee would be £5.60. If the donor used a non-European card the fee would be £11.60. If 10 UK donors used UK cards the Stripe fee would be £7.60.

9. Protecting Your Password

If you choose to register you will be asked to choose a password to protect your secure account. You are responsible for maintaining the confidentiality of your password. If any of your login details are lost, stolen, misused, used without authorisation, or you believe that they may have become known to another person, you must inform us immediately by e mail.

10. Privacy Policy

We will not share your personal details with any third party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these terms and conditions. By agreeing to these terms and conditions you also agree to the way we use and protect your personal information.

11. Child Protection Policy

Inspire a Star is committed to the protection of children who are registered on our website as set out in our Child Protection Policy. Our Child Protection Policy forms part of these Terms and Conditions. As a “Star” on the site or as parent or guardian, by agreeing to these terms and conditions you are providing consent that the  photograph uploaded as part of the creation of the profile page can be displayed on the website.

12. Links to Other Sites

Please be aware that our site may provide access to other web sites by linking to them. We are not responsible for the data policies (including data protection and cookies), content or security of these linked web sites. Inclusion of a link to another website does not imply endorsement of its contents or opinions.

13. Suspension of Service and Removal of Star’s Profile Page

We reserve the right at any time, at our sole discretion and without notice, to suspend the provision of services, delete any content and to prohibit you from using all or part of the IAS service.

14. Changes to the Service

We will make every effort to ensure that the website and other services are available continuously, but we reserve the right to change, suspend or discontinue all or any part at any time with or without notice. We cannot guarantee uninterrupted access to the website and we do not guarantee its operation or availability.

15. Disclaimer and Limitation of Liability

You use IAS services at your own risk. We are not liable for any loss or damage which you may suffer through the use of Inspire Giving.

16. Third Party Rights

A person who is not party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

17. Governing Law

These Terms and Conditions and any non-contractual obligations arising in connection with them are governed by English Law and are subject to the exclusive jurisdiction of the English courts.
